1. Acceptance of Terms

By accessing or using the noclara website (https://noclara.com/), purchasing our products, or engaging with our services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, you must not use our Services.

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Services after changes are made constitutes your acceptance of the revised Terms.

2. Eligibility

You must be at least 18 years of age (or the legal age of majority in your jurisdiction) to use our Services or make a purchase. By using the Services, you represent and warrant that you meet this eligibility requirement and have the legal capacity to enter into binding agreements.

3. Orders & Payments

Order Placement: When you place an order, you make an offer to purchase our products. We reserve the right to accept or reject your order for any reason, including but not limited to product unavailability, errors in pricing, or suspected fraud.

Payment: You agree to pay the full amount for your order (including taxes, shipping fees, and other charges) at the time of checkout. We accept major credit cards (Visa, Mastercard), PayPal, bank transfers, and local Indonesian payment methods. Payment is processed securely through our third-party payment providers, and we do not store your payment details.

Order Modifications/Cancellations: You may modify or cancel your order within 2 hours of placement by contacting our customer service. Once your order has been processed for shipping, modifications or cancellations are no longer permitted.

4. Shipping & Delivery

Shipping Options: We offer standard shipping to all destinations. Express shipping is available for an additional fee at checkout. Shipping fees are calculated based on your location and order weight.

Delivery Times:

  • Indonesia Domestic: 2–3 business days after dispatch
  • International: 5–7 business days after dispatch (up to 10 business days for remote regions)

We are not responsible for delays caused by third-party carriers, customs clearance, or unforeseen events (e.g., natural disasters, strikes). You are responsible for providing accurate shipping information; we are not liable for lost or delayed orders due to incorrect details.

5. Returns & Refunds

Return Policy: You may return unused, unaltered products in their original packaging within 30 days of delivery for a refund or exchange. Customized products are non-returnable unless defective.

Refund Process: Refunds will be processed within 3–5 business days of receiving and inspecting the returned item. Refunds are issued to your original payment method and may take 5–7 additional business days to reflect in your account (depending on your bank/payment provider).

Damaged/Incorrect Items: If you receive a damaged or incorrect item, contact our customer service within 7 days of delivery with photos of the item and packaging. We will arrange a replacement, refund, or repair at no additional cost.

6. Product Information

We make every effort to ensure product descriptions, images, and pricing are accurate. However, we do not warrant that product information is error-free, complete, or up-to-date. We reserve the right to correct pricing errors or update product details at any time.

All our leather products are handcrafted, and minor variations in color, texture, or finish are normal and do not constitute a defect.

7. Intellectual Property

All content on our website (including text, images, logos, designs, and trademarks) is the intellectual property of noclara or its licensors and is protected by copyright and trademark laws. You may not reproduce, distribute, modify, or use any content without our prior written permission.

8. Limitation of Liability

To the maximum extent permitted by law, noclara shall not be liable for any indirect, incidental, special, or consequential damages (including loss of profits, data, or goodwill) arising from your use of the Services or purchase of our products. Our total liability for any claim related to the Services or products shall not exceed the total amount paid by you for the relevant product.

This limitation does not apply to damages caused by our gross negligence, willful misconduct, or failure to comply with legal obligations.

9. Indemnification

You agree to indemnify, defend, and hold harmless noclara, its directors, employees, and affiliates from any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising from your violation of these Terms, use of the Services, or infringement of any third-party rights (including intellectual property or privacy rights).

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Indonesia, without regard to its conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Ciamis, West Java, Indonesia.
